CLIENT SERVICE AGREEMENT
This Client Service Agreement ("Agreement") is entered into by and between [Company], hereinafter referred to as the "Client," and The Contractor Consultants. This Agreement outlines the terms and conditions under which the Contractor Consultants will provide recruitment and hiring services to the Client.
0. Payment Terms and Commitment
0.1 Payment Structure: The initial payment made by the Client, as specified in the pricing section of this Agreement, covers both the initial asset buildout and the first month of outsourced hiring services provided by The Contractor Consultants.
0.2 The services provided under this Agreement are month-to-month with no long-term contract. A second payment will be due 30 days after the completion of the Onboarding call. This payment will cover the second month of outsourced hiring services.
0.3 Cancellation requests must be made in writing and received at least 14 days prior to the next scheduled payment date to ensure adequate time to update our payment system, take down all hiring funnels, and ensure proper communication with any candidates in process. This time is necessary to effectively terminate services and minimize disruption to ongoing hiring processes.
- Our Client Promise
The Contractor Consultants promise to provide the following services to support the Client's hiring efforts:
1.1 Building Career Page / Writing Job Descriptions: We will collaborate with the Client to create engaging career pages and write job descriptions tailored to the Client's unique needs.
1.2 Managing Job Posts: Our team will oversee job postings on various platforms to maximize exposure, keeping the Client updated on progress.
1.3 Managing Applicant Intake and Review: We will handle applicant intake, ensure proper vetting, and provide statistics on the average percentage of rejected applicants for transparency.
1.4 Communication with Applicants: Our team will manage all communication with applicants, including scheduling, confirmations, and initial interviews. Acknowledgement of new applications will be sent to the Applicant within 10 minutes of submission.
1.5 Conduct Initial Phone Interviews: We will conduct initial phone interviews with candidates on the Client's behalf.
1.6 Schedule Final Interviews: We will schedule and coordinate final interviews between the Client and qualified candidates.
1.7 Rejection Letters and Conversations: We will manage the task of sending rejection letters and conducting rejection conversations in a respectful and professional manner.
1.8 Background Checks and Reference Calls (Post-Offer): Management of background checks as needed by the client. This is a pass-through service and the cost of any background checks will be added to the monthly subscription price.
1.9 Hiring Compliance & Regulations (Federal & State): We will ensure that all hiring practices conducted by The Contractor Consultants comply with federal and state regulations.
1.10 Position Limitation: The base package at $1,495 includes 3 positions to be managed concurrently. Additional positions can be added at $495 per position.
- Client Expectations
2.1 The Client agrees to respond to Candidate Endorsements provided by the Contractor Consultants within 48 hours of receiving them.
2.2 The Client must disable any of their own Job Advertisements/postings that directly compete with the services provided by The Contractor Consultants.
2.3 If the Client chooses to run their own job postings or work with other providers such as recruiters, staffing agencies, or any other similar service during the term of this agreement, the Money Back Guarantee outlined in Section 4 will be voided.
- Client Adherence to Labor Laws & Release of Liability
3.1 The Client acknowledges the importance of adhering to all federal and state labor laws in the hiring process and will be responsible for compliance with such laws.
3.2 The Client hereby releases The Contractor Consultants from any liability of Labor Law violations (Federal or State) conducted by the Client.
3.3 The Client acknowledges that The Contractor Consultants are not liable for any actions, decisions, or outcomes related to the employment of candidates hired through our services. The Client assumes full responsibility for the candidates' employment and any consequences thereof.
- 60-Day Money Back Guarantee
4.1 Outsourced Hiring Guarantee: A full refund for the total amount paid for the first 60 days of Outsourced Hiring Services is available, provided the Client requests this refund within 60 days from the date of the onboarding call and complies with the expectations set forth in Section 2 of this Agreement.
4.2 Commitment Period: The Client acknowledges that a 60-day period is necessary to adequately demonstrate the effectiveness of our Outsourced Hiring Services. Opting to terminate services before the completion of this 60-day window will result in the forfeiture of the Money Back Guarantee.
4.3 Non-disparagement: All parties involved agree to refrain from making any disparaging statements about each other's brands, business practices, or this agreement, to any third party or through any media channel, without the express written consent of all parties involved. This includes any false, misleading, or negative comments, irrespective of their truth.
- Expectations on Hiring and Delivery
5.1 In recognition of the challenging labor market, the Client understands that they are paying The Contractor Consultants to assist with the recruitment process and not paying traditional recruiter fees. The fees charged by The Contractor Consultants are reflective of the current labor market conditions.
5.2 If the Client adheres to the communication expectations outlined in section 2, and The Contractor Consultants fail to provide 3 Interviews and/or 1 hire by the end of the 60-day period, the initial payment made by the Client will be refunded in accordance with section 1.
By accepting these Terms of Service, the Client acknowledges that they have read, understood, and agreed to the terms and conditions outlined herein.
